Discrimination Complaints
Discrimination complaints are among the most complex and sensitive claims an employer can face. They can arise under a range of protected characteristics ÔÇö including age, disability, race, religion or belief, sex and sexual orientation ÔÇö and can involve direct discrimination, indirect discrimination, harassment or victimisation. In Northern Ireland, claims may also be brought before the Fair Employment Tribunal on grounds of religious belief or political opinion.
These cases often involve detailed factual disputes, shifting burdens of proof and significant potential awards. Responding to them properly from the outset ÔÇö including to any statutory questionnaire ÔÇö is essential to protecting the employer’s position.
We help you to:
- understand the specific type of discrimination alleged and the legal framework that applies
- respond carefully and accurately to any statutory equality questionnaire served by the claimant
- gather and organise evidence to challenge the claimant’s account and support the employer’s defence
- address the burden of proof and understand what the employer must demonstrate to rebut an inference of discrimination
- prepare for the particular procedural requirements of Fair Employment Tribunal proceedings where relevant
- manage reputational sensitivity and ensure internal communications around the claim are handled appropriately
- advise on the merits of defending versus settling, taking into account the potential level of any award
